David G. Knitter, Attorney | Knitter & Knitter, LLP

Attorney David G. Knitter practices in the area of financial elder abuse, contested conservatorships and trusts and estates litigation. He is a member of the Executive Committee for the Trusts and Estates Section of the State Bar of California (TEXCOM). He is Past President of the Solano County Bar Association (SCBA) and was honored as Attorney of the Year in 2006. Mr. Knitter has written extensively on financial elder abuse, undue influence and probate and trust litigation issues. He has presented locally and nationally for organizations including the State Bar of California, California Continuing Education of the Bar, the California Administrative Office of the Courts, National Academy of Elder Law Attorneys (NAELA), LAS, Elder Financial Protection Network, several county bar associations, estate planning councils, civic and professional groups. Topics have included undue influence, financial elder abuse, probate and trust litigation and related subject matter.

Mr. Knitter was honored by the State of California and other political bodies for his contributions to elder abuse. He was featured as one of “NAELA’s litigators,” appearing on the cover of the NAELA News and is a former member of the NAELA Advocacy and Litigation Subcommittee.

Mr. Knitter’s 25 years of litigation expertise includes trust and probate litigation, claims and defense of undue influence and financial elder abuse, and contested conservatorships. His prior experience in litigating business and real estate claims makes Mr. Knitter uniquely qualified to handle most disputes. He also serves as a mediator and arbitrator in these and other areas of practice.

Standing Issues in Trusts, Estates, and Elder Abuse Litigation

Establishing standing is a prerequisite to pursuit of any court action. There are many traps for the practitioner due to the differences in who may pursue certain claims in the different types of litigation. This presentation will provide a summary of who has standing to pursue actions in a multitude of different trust and estate proceedings, elder abuse matters, and power of attorney actions.
